OFFICIAL RULES: By participating in the 2011 American League Championship Ring Raffle ("the Raffle"), purchasers agree to be bound by these Official Rules and by the decisions of Texas Rangers Baseball Foundation (the "Foundation"), which shall be binding and final as to all matters related to the Raffle. The Raffle is subject to all applicable federal, state and local laws.
FOUNDATION: Texas Rangers Baseball Foundation, 1000 Ballpark Way, Suite 400, Arlington, Texas 76011. Nonprofit Tax ID Number 75-2404714. The Foundation is a 501(c)(3) charitable organization.
NET PROCEEDS: All net proceeds of the Raffle will benefit the Foundation, and the programs and needs it supports, including youth health, sports and education.
PRIZE: One (1) prize will be awarded in this Raffle: a personalized and fitted 2011 American League Championship Ring (the "Prize"). The design and personalization of the Prize will be at the Foundation's discretion. The Prize is awarded "as is," with no warranty or guarantee of any kind by the Foundation, whether express or implied. The Winner may not substitute, assign or transfer the Prize or redeem the Prize for cash or other consideration. Estimated Retail Value of the Prize: $15,560.
ELIGIBILITY TO ENTER: Raffle tickets may be purchased only in accordance with these Official Rules and Texas law. This Raffle is void wherever prohibited by law. The following persons are not eligible to participate in the Raffle or to win any Prize: Employees, officers, directors, members, agents and consultants of the Foundation and any and immediate family members of any ineligible person. "Immediate family members" means spouses, parents, grandparents, children, grandchildren, and siblings (and any of their respective spouses).
RAFFLE TICKETS: Raffle tickets are available for purchase (i) in-person at Rangers Ballpark during MLB games from April 6 - August 29, 2012, and at other Dallas/Fort Worth events and location, as selected by the Foundation; (ii) on the internet at www.texasrangers.com/raffle by residents within a 200 mile radius of Rangers Ballpark; and (iii) by telephone by calling the Foundation at (817) 436-5933. Raffle ticket prices are: $5 for one (1) entry, $10 for three (3) entries, or $20 for seven (7) entries.
Raffle ticket purchases shall be final, and no refunds or replacements will be issued by the Foundation. These Official Rules are available on www.texasrangers.com/raffle and at Rangers Ballpark and should be read before purchase. No portion of the Raffle ticket price may be deducted as a charitable contribution for federal income tax purposes. The odds of winning depend on the number of Raffle tickets purchased. Raffle tickets shall not be re-sold or given-away.
DRAWING: An official winner (the "Winner") will be selected in a random drawing by the Foundation from all eligible raffle tickets purchased on or about August 29, 2012. The winning Raffle ticket number will be announced by Foundation within five (5) days of the drawing and displayed on www.texasrangers.com/raffle. If the Foundation is unable to contact the owner of the winning Raffle ticket after diligent efforts to do so for five (5) calendar days, then the Rangers may select an alternate winner. The Winner need NOT be present in person at the drawing in order to win. The Winner must sign the Foundation's prize affidavit promptly in order to be eligible to win. The Winner must present the winning ticket, follow all Official Rules and reasonably cooperate with the Foundation.
The Foundation shall use the following rules to determine the Winner: (1) in the case of a Raffle ticket that was purchased at www.texasrangers.com/raffle, the Foundation shall conclusively presume that the purchaser of that Raffle ticket, as determined by credit-card purchase records, is the lawful owner of that Raffle ticket and that Raffle ticket's winning number and (2) in the case of a Raffle ticket that was purchased in person, the Foundation shall conclusively presume that the person who is listed as the purchaser of that Raffle ticket is the lawful owner of that Raffle ticket.
The Prize will be awarded to the Winner at the September 29, 2012, Texas Rangers' game and participation is mandatory for Prize acceptance. The Rangers will provide the Winner with 2 tickets to the game. The Winner is solely responsible for his/her own transportation and other travel costs associated with his/her attendance or delivery of his/her Prize. All federal, state and local income taxes are the sole responsibility of the Winner.
The Foundation, Rangers Baseball LLC, Major League Baseball, Major League Baseball Advanced Media, and each of their respective affiliates, owners, employees, agents and partners (the "Released Parties") are not responsible for: (1) Raffle tickets which are stolen, lost, damaged, illegible, given away or no longer in the purchaser's possession; (2) Raffle tickets that have been or may have been tampered with or re-sold in violation of these Official Rules; or (3) Raffle tickets or payments that are delayed, misdirected, undelivered, not fully captured, or garbled as a result of any failure or problem with the availability, functionality, or use of any computer, equipment, or website.
RELEASE OF LIABILITY: Entrants, by participation in the Raffle, agree that Released Parties have no liability whatsoever for, and shall be held harmless by entrants against, any liability for injuries, losses, cost, expenses or damages of any kind, including damages for death, personal injury, property damage or property loss, or other harm resulting from participation in this Raffle or the acceptance, possession, misuse or use of any Raffle ticket or Prize, the Official Rules and their application thereof, all means of Raffle ticket sales, and Winner selection.
PUBLICITY RELEASE: The Winner, by accepting his/her Prize, grants the Foundation and its' designees and affiliates, including Rangers Baseball LLC, full permission, except where legally prohibited, to use the Winner's name, address (city and state only), photograph, voice and/or other likeness and Prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity.
COPYRIGHT: All Raffle materials are copyrighted by the Foundation and may not be copied, reproduced or used for any purpose without the Foundation's prior written consent.
GOVERNING LAW: The Raffle and these Official Rules are subject to and governed by the laws of the State of Texas. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular person or circumstance, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all of these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law.
